In their 2004 season 2, episode 4 show “War on Drugs” they also talk about “Federal Marijuana”.
Things have change quite a bit as far as medical marijuana goes and states that allow patients to be treated by it.

Penn: Is this not smoking a joint in front of the Capitol?
Irvin: I’m Irvin Rosenfeld I’m one of seven federal medical marijuana patients.
Penn: If you ever wanted incontrovertible proof the government hypocrisy on the subject of drugs listen to this: back in 1978 the government started a program to distribute medical marijuana. Yep Uncle Sam grow it and distributed it. At it’s peak thirty patients were on the program.
For the last 21 years Irvin Rosenfeld has been receiving this little care package from the federal government for his potentially lethal bone tumors.
Irvin: They grow outwardly most of them and what they do is a stretch the muscles in the veins that go over making it very painful and more important any kinda movement can’t tear the muscle or more important tear a vain… and you could hamerage,… and if hamerage breaks of goes to your heart, your brain, your lounges and you could be dead.
Here’s how the marijuana comes. It’s 300 cigarettes and this could be ten right here.
I try to smoke two to three in the morning when I get up. Then I smoke one on the way to work,… driving to work.
I try to take a break around 10:30. Then I try to smoke two after launch if I’m able to.
It’s difficult we trading stocks to be able to take breaks.
Penn: Trading stocks? Oh that’s right.
Irvin’s a very successful stockbroker.
Doesn’t exactly fit the mold of a pothead does he.
Anyway when George senior was in office saying things like… “this scourge will stop”…. funding of medical marijuana program didn’t make much political sense so he closed it down in 1992. Just in time for his reelection campaign.
Today there are only seven patients who still receive the federal marijuana and they will until they die.
Irvin: Thank God that I’ve found it and thank God that I’m getting it from the federal government.
I couldn’t afford it otherwise. I’ve been able to fight a very devastating disease with the right medicine.
Penn: Irvin and the other members of the fortunate 7 know they are the last of a dying breed.
Irvin: I think that for the government waiting for,.. is that one day we won’t be around and then they can end it all
Penn: So why is Ervin smoking in front of the White House and the Capitol building?
Because he can.
And well you… you gotta admit it makes a really cool shot for the promos.
We’re also hoping someone who runs the country would look out their fuckin window and learn something.
Irvin: 21 years I’ve been smoking marijuana legally right about the federal government and they still don’t know how well it works.
